Terms of Service

1. Acceptance of Terms
By accessing or using ArtisanBD ("the Platform"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these terms, you may not use the Platform. We reserve the right to modify these terms at any time; continued use of the Platform after changes constitutes acceptance.
2. Eligibility
You must be at least 18 years old to use the Platform. By creating an account, you represent that you meet this requirement and that all information you provide is accurate and complete. Businesses may use the Platform provided an authorised representative agrees to these terms.
3. User Accounts
- You are responsible for maintaining the confidentiality of your account credentials
- You are responsible for all activities that occur under your account
- Notify us immediately at support@artisanbd.com of any unauthorised account use
- We reserve the right to suspend or terminate accounts that violate these terms
- One person may not maintain multiple buyer or seller accounts without prior written approval
4. Buyer Obligations
- Provide accurate shipping information for all orders
- Pay for purchases at the time of order placement
- Communicate respectfully with sellers and ArtisanBD staff
- Not engage in fraudulent chargebacks or false dispute claims
- Use products purchased only for lawful purposes
5. Seller Obligations
- List only items that are genuinely handmade, hand-designed, or hand-altered by the seller
- Provide accurate product descriptions, images, and pricing
- Fulfil orders within the stated processing time
- Comply with all applicable local and international laws regarding the sale of goods
- Maintain professional communication with buyers
- Not engage in keyword spamming, misleading listings, or price manipulation
- Maintain sufficient stock levels; fraudulent "out of stock" cancellations may result in account suspension
6. Fees & Commissions
ArtisanBD charges sellers a transaction commission on each sale:
- Standard tier: 12% commission per transaction
- Plus tier: 10% commission with subscription fee
- Pro tier: 8% commission with higher subscription fee
VAT (currently 15%) is collected and remitted on behalf of sellers where applicable. Fees are deducted before payouts are made. Payouts are processed weekly via bKash or Nagad. ArtisanBD reserves the right to change fee structures with 30 days' written notice.
7. Prohibited Items
The following items may not be listed on ArtisanBD:
- Mass-produced, factory-made items not created or significantly altered by the seller
- Counterfeit or replica branded goods
- Hazardous materials, weapons, or illegal substances
- Adult content or items depicting violence
- Items that infringe on intellectual property rights
- Live animals or endangered species products
- Items that violate Bangladeshi law or international trade regulations
8. Payments & Escrow
All buyer payments are held in escrow by ArtisanBD until the buyer confirms receipt of the order or 7 days after the estimated delivery date (whichever comes first). This protects both buyers and sellers. Sellers receive payouts after the escrow period. Disputed transactions may be held for longer pending resolution.
9. Returns & Refunds
Sellers must accept returns for items that are significantly not as described or damaged in transit. Sellers set their own return windows (minimum 7 days from delivery). Buyers must initiate returns within the seller's stated window. ArtisanBD may intervene in disputed cases at its sole discretion. Refunds are processed within 5–10 business days after return confirmation.
10. Dispute Resolution
If a dispute arises between a buyer and seller, both parties should first attempt to resolve it through our messaging system. If unresolved within 48 hours, either party may open a formal dispute with ArtisanBD. Our moderation team will review the case and issue a binding decision within 5 business days. ArtisanBD's decision is final for transactions conducted on the Platform.
11. Intellectual Property
Sellers retain ownership of their product designs, photographs, and creative content. By listing on ArtisanBD, sellers grant us a non-exclusive, royalty-free licence to display, reproduce, and promote their listings on our platform and in marketing materials. ArtisanBD's branding, logos, and platform design are our exclusive intellectual property.
12. Limitation of Liability
To the maximum extent permitted by law, ArtisanBD shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability to any user for any claim shall not exceed the total fees paid by that user in the 12 months preceding the claim.
13. Governing Law
These Terms shall be governed by the laws of the People's Republic of Bangladesh. Any disputes shall be subject to the exclusive jurisdiction of the courts of Dhaka, Bangladesh.
